TERMS OF SERVICE — SHOVELLE

1. WHO WE ARE

Shovelle is a trading name of Attention Span Limited, a company registered in England and Wales (company no. 14114363), registered office 20D Goldney Road, London W9 2AX, United Kingdom ("we", "us", "our"). Email: sup@shovelle.co.uk

These Terms apply to your use of shovelle.co.uk (the "Site") and to all purchases made through it. Please read them before ordering. Our Privacy Policy (https://shovelle.co.uk/policies/privacy-policy) and Refund Policy (https://shovelle.co.uk/policies/refund-policy) also apply.

If you are a consumer, nothing in these Terms affects your statutory rights.

2. ELIGIBILITY AND ACCOUNTS

You must be at least 18 years old to place an order. You must provide accurate, complete and current information, including your delivery address. You are responsible for keeping your account credentials secure and for all activity under your account.

3. OUR PRODUCTS

All Shovelle products are decorative jewellery, designed and sold to be worn. We accept no responsibility for any use of our products other than wearing them as jewellery.

Our products are handmade. Minor variations in size, weight, finish and colour between individual pieces and product images are a natural feature of handmade jewellery and are not defects. Colours may appear differently depending on your screen settings.

Sterling silver naturally tarnishes over time, and chains and clasps can break under force or strain. Tarnishing, normal wear and tear, and damage caused by accidents, misuse, improper care, or contact with chemicals, cosmetics or water are not defects.

Products are sold for personal use only and not for commercial resale.

4. ORDERS AND CONTRACT FORMATION

Placing an order is an offer to buy. The automatic order confirmation email we send after you order only acknowledges receipt of your order. It does not mean your order has been accepted. A contract between you and us is formed only when we send you an email confirming that your order has been dispatched.

We may decline any order before dispatch, including where a product is unavailable, where we cannot deliver to your address, where there is an error in price or product description, or where we suspect fraud or a breach of these Terms. We may limit quantities per customer. If we decline your order after payment, we will refund you in full.

5. PRICES AND PAYMENT

The prices shown on the Site are final prices. Delivery charges are shown at checkout before you pay. Orders delivered outside the European Union, including to the United Kingdom, may be subject to import duties, taxes and customs fees charged by the destination country. Unless collected at checkout, these are payable by you.

If we discover an error in the price of a product before dispatch, we will contact you and you may either confirm the order at the correct price or cancel it for a full refund. If a pricing error is obvious and could reasonably have been recognised by you as a mistake, we are not obliged to supply the product at the incorrect price, even after dispatch.

You confirm that you are authorised to use the payment method you provide.

6. DELIVERY

Orders are dispatched from our fulfilment partner in Germany. Delivery times shown are estimates. Unless another date has been agreed, we will deliver within 30 days of the contract being formed.

We are not responsible for delays caused by events outside our reasonable control, including carrier delays, customs processing, strikes, severe weather or public health events. If such an event causes significant delay, we will contact you, and you may cancel for a refund of anything paid for undelivered products.

You are responsible for providing a correct and complete delivery address and for collecting your parcel. If a parcel is returned to us because the address was incorrect or incomplete, or because it was not collected, we may charge you the cost of re-delivery, or cancel the order and refund the price of the products less the original and return delivery costs.

The products become your responsibility once they are delivered to the address you provided, or to a person or safe place you nominated.

7. CANCELLATIONS, RETURNS AND FAULTY PRODUCTS

Your right to cancel and your rights in relation to faulty, damaged or incorrect products are set out in our Refund Policy (https://shovelle.co.uk/policies/refund-policy). Before contacting your bank or payment provider about a purchase, please contact us at sup@shovelle.co.uk so we can try to resolve the matter.

8. INTELLECTUAL PROPERTY

All content on the Site, including the Shovelle name, logo, product designs, images, text and graphics, is owned by or licensed to Attention Span Limited. You may use the Site for personal, non-commercial purposes only. You must not copy, reproduce, distribute, modify or commercially use any content or designs without our prior written consent.

9. REVIEWS AND FEEDBACK

If you submit reviews, photos, ideas or other feedback, you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify and publish it for any purpose, including marketing. You confirm that you own the rights to anything you submit and that it is not unlawful, misleading or offensive. We may remove any submission at our discretion.

10. USE OF THE SITE

You may use the Site for lawful purposes only. You must not: use it in breach of any law; transmit malicious code; attempt to gain unauthorised access to it; scrape, copy or harvest data from it; use automated tools, robots or AI agents to access it without our consent; impersonate any person; or interfere with its operation or security.

Any automated agent accessing the Site must identify itself in its user agent string as "Agent/[agent name]", must not mimic human behaviour or circumvent CAPTCHAs, and must truthfully disclose that it is automated when asked. We may block automated access at any time.

We may suspend or terminate your access to the Site if you breach these Terms. This does not affect orders already dispatched to you.

The Site and its content are provided "as is" and "as available". We do not guarantee that the Site will be uninterrupted, error-free or free from viruses. Third-party tools and links on the Site are provided for convenience only. We do not control them and are not responsible for their content.

11. SHOPIFY

Our store is hosted on Shopify. All sales are made directly between you and Attention Span Limited. Shopify is not a party to your purchase and is not responsible for it.

12. OUR LIABILITY

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. We are not responsible for loss or damage that is not foreseeable.

We supply products for domestic and private use only. If you use them for any commercial or business purpose, we have no liability to you for any loss of profit, business, revenue or business opportunity.

Our total liability to you in connection with any order is limited to the price you paid for that order.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights as a consumer, or for any other liability that cannot be limited or excluded by law.

13. YOUR RESPONSIBILITY

You are responsible for any loss or damage we suffer as a direct result of your breach of these Terms or your fraudulent use of the Site.

14. TRANSFER, SEVERABILITY AND WAIVER

We may transfer our rights and obligations under these Terms to another organisation. This will not reduce your rights. You may not transfer your rights under these Terms without our written consent.

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions remain in full force.

If we do not enforce any right under these Terms immediately, we may still enforce it later.

15. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of England and Wales. If you are a consumer, you also benefit from any mandatory protections of the law of the country in which you live.

Disputes may be brought before the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts. If you are a consumer living in the European Union, you may also bring proceedings in the courts of your country of residence.

16. CHANGES TO THESE TERMS

We may update these Terms from time to time. The version in force at the time you place your order applies to that order.
